DEVOLUCIÓN DE TODO LO COBRADO MEDIANTE LAS "CLAUSULAS SUELO"

Estimados lectores, hoy abrimos con la reciente acontecimiento relativo a las "cláusulas suelo", y es que la Comisión de la Unión Europea ha dictaminado que las entidades de crédito y las Cajas de Ahorros deben devolver todo lo cobrado mediante la imposición de estas cláusulas abusivas.  Recordemos que hasta ahora la doctrina jurisprudencial venía señalando que tras la declaración de nulidad de una cláusula suelo, sólo se debían restituir las cantidades cobradas con el tope máximo del 9 de mayo de 2013. Es decir, una vez declarada la nulidad de la cláusula ésta era eliminada, pero el consumidor no podía recuperar retroactivamente las cantidades cobradas en una fecha anterior al 9 de mayo de 2013. Esta respuesta carecía de justificación a ojos de los operadores jurídicos, que hemos apostado por cambiar la tendencia. Así pues, la noticia llegó a nosotros el pasado día 27 de octubre, haciéndose público el informe que la Comisión Europea ha emitido solicitando que se reintegre todo el dinero cobrado por aplicar estas cláusulas desde el inicio del crédito, no solo desde mayo de 2013. La Comisión entiende que no es posible que los tribunales nacionales puedan moderar la devolución de lo pagado por el consumidor, ya que si una cláusula es declarada nula, “lo es desde el origen”. Si bien, se trata de un informe, las fuentes jurídicas apuntan que el criterio de Bruselas podría guiar las futuras reclamaciones interpuestas, así como las macrodemandas que se encuentran en este momento a la espera de sentencia.
